Conditions for Registration of Residential Properties
for Purpose of Stamp Duty Exemption

Exemption Period :

Subject to Stamp Duty ( (Exemption) (No.3) Order 2020 P.U. (A) 216/2020 and Stamp Duty (Exemption) (No.4) Order 2020 P.U. (A) 217/2020 dated 28 July 2020, stamp duty exemptions are given for residential properties which are sold during the period between 1 June 2020 to 31 May 2021.

Eligibility for Exemption :

Only ‘residential properties’, defined as houses, condominium units, apartments and flats including service apartments and SOHO built and used as dwelling – with valid Developer’s Licence (DL) and Advertisement and Sale Permit (AP) or verified by the Ministry of Housing and Local Government (KPKT) (where applicable) or completed with CCC/CF (where applicable) are eligible to register, all other property types are not included in this exercise;

The service apartment and SOHO must be for residential use only and cannot be converted for commercial activities;

Property price (before discount) is within the range of RM300,001 to RM2.5 million;

It must be a sale from a developer to a purchaser or co-purchasers, all of whom are Malaysian citizens;

The stamp duty exemptions are applicable for the purchase of residential unit/s for Sale & Purchase Agreement executed between 1 June 2020 to 31 May 2021;

A minimum of 10% discount (from property price) applicable to all units that are not subjected to government price control;

Eligible properties in Peninsular Malaysia must be registered with REHDA 

Malaysia. Eligible properties in Sabah and Sarawak must be registered with SHAREDA (shareda.com) and/or SHEDA (www.sheda.org.my) respectively;

The stamp duty exemption is applicable to the following in relation to the purchase of residential property by an individual Malaysian citizen:

 如何延长地契

地契到期，在海外房产中是一个比较常见的问题。但具体如何解决想必也是某些马来西亚房产投资爱好者头痛的事情吧。就此，咱们来谈谈马来西亚购房指南之如何延长地契。

读者林先生和徐先生都去马来西亚买房后，分别来信提出关于租赁契约地契届满后，应该如何处理的事项，他们指出，目前居住在马来西亚老社区的房屋，距离地契租赁期满剩下不到30年的时间，是否可以开始提出延长地契申请，还有更新地契收费是多少？

答：购屋者协会中文组主任陈锺灵说，租赁契约的房屋在期满之前，业主需要开始提出延长地契申请，以两位读者来信所指的地契年限剩下不到30年时间，不妨向产业所属的地方政府办事处瞭解，现在是否可以开始提出申请，或者是不需要这么急，再等一个时候才进行。

由于两位读者在信中没有提及产业所在州属，或者说产业属于哪一个大马地方政府所管辖，因此，无法给予收费方面的意见，因为马来西亚每个州属或地方政府设定的收费架构会有些不同，甚至是办理的程序可能也不一样。

另外，产业的类型、所在地区，是否位于旺区或偏僻地方、房产单位面积大或小、是有地房屋或是普通公寓，例如没有电梯的5层公寓，还有整个社区的房产单位数目多或少，这些都有可能影响延长地契收费的设定。

林先生和徐先生可以连同社区的邻居，或是个别走一趟地方政府办事处，以瞭解延长地契的程序，最重要的是先查清楚产业所属的地方政府，避免登错政府部门，既浪费时间和精力的同时，又无法获得所需要的资讯。

在签署买卖合约后，这房屋是否还属于我们？是否不需要继续偿还管理维修费？在签署合约后的这段期间，我所偿还的房屋贷款，是否可向对方索回？

林先生说，他在雪兰莪首邦市拥有一间公寓，因为现金周转问题，已于去年10月将公寓转售给其他人，并在当时签署买卖合约。

原本以为签署买卖合约后，就可以在约定的期限内完成买卖手续，可是如今就快过了6个月，交易仍未完成。

律师告诉他，相关的文件已获批准，现在要进行的是银行方面的事务，买方申请的银行贷款已获批准，不过还需一些时间才能完成有关交易。

但是，如今又出现其他问题，律师说有些文件需要发展商签名，才能使整个交易尽快完成。

林先生说，当初签署买卖合约后，就停止偿还管理维修费，现在发展商要他偿还一笔超过1000令吉的管理维修费，才同意在文件上签名。

请问：

1.在签署买卖合约后，这房屋是否还属于我们？是否不需要继续偿还管理维修费？

2.在签署合约后的这段期间，我所偿还的房屋贷款，是否可向对方索回？

3.我听说售卖房屋的人，不需要支付律师费，买房屋的人才需要支付律师费，情况是否这样？

答：林先生售卖的公寓，应该是还未有分层地契的单位，因此售卖之前需要发展商签名才能进行接下来的交易程序。

交屋前
卖方仍需付管理维修费

买卖双方在签署买卖合约后，卖方仍需要继续支付管理维修费，直到卖方将房屋交给买方，管理维修费才由买方支付。

购屋者协会中文组主任陈钟灵指出，卖方将产业单位交给买方时，必须确保清还所有的费用，譬如管理维修费、水电费、排污费、门牌税等。

另外，在签署买卖合约后，卖主仍需继续偿还房屋贷款，也没有所谓可以向买方索回这种事情，况且买方也支付购屋首期钱，他是否也能说支付了一笔首期钱，偿还买卖合约、贷款合约律师费，仍需在外租房屋，应该向卖方索回在外租房的费用。

如果彼此坚持本身的看法，那么将会影响交易的进行。另外，如果这是他第一次购买房屋，相信他也希望能早日完成交易，以便可以搬进自己的屋子。

在房屋买卖这项交易，买方需要支付买卖合约律师费、转移产业拥有权印花税、如果有贷款，还需要支付贷款合约律师费、印花税等。

至于卖方除了付给发展商批准交易的行政费，也需要支付律师费，费用以交易价做为计算基础，有一部份人为了节省支出，与买方共用律师，这位也代表卖方的律师向卖主征收阅读合约服务费及代为呈报税务的费用。

买卖双方共用同一名律师是不受鼓励的做法，因为在交易过程中，若出现枝节问题，律师应该代表买方或卖方利益为出发点，成为具争议的问题。
